Terms of Service

Welcome to Color Walk. By accessing or using ourcolorwalk.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1. The Platform

Color Walk is an exclusive, invite-only photography collective. We provide a platform for users to curate, upload, and view thematic color-based photo galleries.

2. Accounts and Security

  • Eligibility: You must be at least 16 years of age to use this Service.

  • Account Integrity: You are responsible for maintaining the confidentiality of your password and account. You agree to notify us immediately of any unauthorized use of your account.

  • Invites: The ability to invite others is a privilege, not a right. We reserve the right to revoke your invite privileges or suspend accounts that abuse the invite system to spam or harass others.

3. Content Ownership and Licenses

  • You Own Your Photos: You retain all copyright and ownership rights to the photographs you upload.

  • License to Color Walk: By uploading photos, you grant Color Walk a worldwide, non-exclusive, royalty-free license to host, store, optimize (including converting formats to WebP and resizing), and publicly display your images and associated EXIF metadata on the Service.

  • Representations: You represent and warrant that you own the rights to the content you upload, and that your content does not infringe on the privacy, copyright, or intellectual property rights of any third party.

4. Prohibited Conduct

You agree not to:

  • Upload illegal, explicit, highly offensive, or non-consensual imagery.

  • Harass, abuse, or harm other users.

  • Use automated scripts, bots, or scrapers to extract data or images from the Service.

  • Attempt to circumvent the Service's security, including uploading files containing malicious code or attempting EXIF injection attacks.

5. Real-World Activities, Events, and Assumption of Risk

Color Walk provides digital themes and may, from time to time, organize, sponsor, or collaborate on physical group events, meetups, or photowalks. By participating in any independent "color walk" or any officially organized Color Walk event, you acknowledge and agree that:

  • Assumption of Risk: You voluntarily assume all risks associated with your participation, whether you are shooting independently or attending a group event.

  • Personal Responsibility & Legal Compliance: You are solely responsible for your own safety, well-being, and situational awareness. You agree to obey all local laws, traffic regulations, and property rights. You will not trespass on private property or put yourself or others in dangerous situations to capture an image.

  • Release of Liability: To the maximum extent permitted by law, you completely release, indemnify, and hold harmless Color Walk, its founders, employees, partners, collaborators, and affiliates from any and all liability, claims, damages, injury, or death arising out of your participation in any real-world photography activities, whether independently inspired by the Service or officially organized by us.

6. Moderation and Enforcement

We employ a community reporting system. If content is flagged as inappropriate, platform administrators will review it. We reserve the right, at our sole discretion, to remove any content, dismiss reports, or permanently terminate any user account without prior notice if we determine a violation of these Terms has occurred.

7. Disclaimers and Limitations of Liability

  • As-Is Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties that the Service will be uninterrupted, completely secure, or error-free.

  • Data Loss: While we utilize robust database architecture, we are not responsible for the loss, corruption, or deletion of your uploaded photographs. You should always maintain your own local backups of your original files.

  • Limitation of Liability: To the maximum extent permitted by law, Color Walk and its administrators shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Newfoundland and Labrador, and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via an announcement on the Service or via email. Your continued use of the Service following such updates constitutes your acceptance of the revised Terms.
